Conditions

These Terms & Conditions (“Terms”) govern your access to and use of the services and products provided by The Performance Leadership & Learning Lab (PL3), (including its affiliates, collectively, “PL3,” “we,” “us,” or “our”).

 

By accessing or using PL3’s tools, products, or platforms (collectively, the “Platform”), you agree on behalf of yourself and any organization you represent (“you” or “your”) that you have read, understood, and agree to these Terms. 

 

PL3 is an alliance of The Crucible, GF Data, and The Culture Think Tank - creating solutions to drive performance, valuation and returns. All payments and invoices are issued and made via Culture AIP, Inc.  

 

If you do not agree to these Terms, do not access or use the Platform.

1. Purpose and Scope
PL3 provides tools, resources, and consulting services designed to align workplace culture, leadership performance, and organizational financial outcomes. These Terms govern access to and use of PL3’s platforms, products, services, tools, content, and any related resources (collectively, the “Platform”). By accessing or using the Platform, you agree to comply with these Terms on behalf of yourself and any organization you represent.

2. Refunds and Cancellations
Refunds may only be requested if no data has been collected through the Platform. Refund requests must be submitted within 30 days of purchase and will be evaluated on a case-by-case basis at PL3’s sole discretion. Purchases of bundled products or subscription services are non-refundable once accessed or used. Product orders cannot be canceled or changed once placed.

3. Licensing and Data Ownership
PL3 exclusively owns all data generated by PL3’s tools, products, and services. 

This includes anonymized and aggregated data used for:
- Comparative metrics
- Data modeling
- Trend generation
- Research and educational materials

Purchasers are granted a limited, non-transferable license to use metrics, trends, and insights solely for internal organizational purposes.

You agree not to:
- Reverse-engineer, copy, or modify any part of the Platform.
- Reproduce, distribute, or commercialize PL3 content without prior written consent.
- Use the Platform to develop or enhance competing tools or products.

 

4. Confidentiality
Both parties acknowledge that they and their respective representatives may have access to confidential information of the other party. Each party agrees to:
- Protect confidential information using reasonable security measures.
- Use confidential information only as necessary to fulfill the purposes of this agreement.
- Not disclose, misappropriate, or misuse confidential information without prior written consent.

5. Use Restrictions
You agree not to:
- Access or use the Platform for unlawful purposes or in violation of applicable laws.
- Share access credentials or allow unauthorized users to access the Platform.
- Engage in data mining, scraping, or similar activities to extract content.
- Post or transmit any content that contains viruses, malware, or harmful code.
- Use the Platform to harm PL3’s reputation or business interests.

6. Dispute Resolution and Governing Law
All disputes arising from or related to these Terms will be resolved in the state or federal courts of Johnson County, Kansas, and governed by applicable federal law and the laws of the state of Kansas. Both parties waive any right to a jury trial.

7. Feedback
Any feedback or suggestions provided by you may be used by PL3 without compensation or attribution to improve the Platform.

8. Modifications to Terms
PL3 reserves the right to update these Terms at any time. Changes will take effect upon posting to the PL3 website. Material changes will be communicated to Platform users. Continued use of the Platform after changes are posted constitutes acceptance of the revised Terms.

9. No Partnership or Employment Relationship
Nothing in these Terms creates a partnership, joint venture, or employment relationship between PL3 and you.
